Birth Injury? Know Your Rights

When labor and delivery teams miss fetal distress, delay a C-section, misuse instruments, or ignore infection, families pay the price.  An injured baby can mean a lifetime of costs.

We build cases the right way: expert review, complete record analysis, and a damages plan that covers real life therapy, equipment, home modifications, and future care.

You’re entitled to:

  • A full investigation measured against the medical standard of care

  • Independent specialists (MFM, neonatology, pediatric neuroradiology, life-care planning)

  • Claims for economic and non-economic losses your family has suffered

  • A relentless advocate from first call through verdict or settlement

Your next move matters. Talk to a lawyer who tries cases and knows birth-injury medicine.  Fill out my Case Submission Form and I will review your case.  If I can help you, I will call you immediately.  If I cannot, I will explain why and provide you with solutions.  Regardless, the consultation is free.

TYPES OF BIRTH INJURY
WE HANDLE

Failure to Diagnose

medical-chart-line-black-icon-vector-26513905_edited.png

Negligence in pregnancy care occurs when providers fail to recognize or diagnose maternal or fetal conditions—such as preeclampsia, gestational diabetes, or infections—that place mother and baby at risk. Missed or delayed diagnosis during pregnancy can lead to severe complications, birth injuries, or even loss of life that could have been prevented with proper monitoring and timely treatment.

Negligent NICU Care

Negligent NICU care occurs when medical providers fail to properly monitor, diagnose, or treat vulnerable newborns, resulting in preventable harm. Common examples include medication errors, delayed treatment of infections, improper use of ventilators, or failure to respond to signs of distress.

Brain Damage

Cerebral Palsy

Negligence leading to hypoxic-ischemic encephalopathy (HIE) occurs when providers fail to recognize and respond to signs of fetal oxygen deprivation before or during delivery. Delayed intervention—such as not ordering a timely C-section or mismanaging fetal distress—can result in permanent brain damage and lifelong disabilities.

Shoulder Dystocia

Brachial Plexus

Negligent obstetric care can cause brachial plexus injuries when excessive traction is applied to a baby’s head, neck, or shoulders during delivery. These nerve injuries often result from mishandled shoulder dystocia and may leave the child with lasting weakness, paralysis, or loss of function in the affected arm.

RECENT CASE RESULTS

Birth Injury

$3,500,000 Confidential Settlement

Adam secured a $3,500,000 settlement for a single mother whose infant suffered severe brain damage while being delivered.

The mother, having no previous pregnancy or medical issues, began laboring and immediately went to a hospital.  For over seven hours, the doctor and nurse who were assigned to look after her watched her baby on the fetal heart monitoring strip.  It was evident the baby was not receiving sufficient oxygen and damage was occurring to the baby’s brain.  Despite the clear signs of fetal distress and hypoxia (lack of oxygen), the doctor and nurse did not order an emergency cesarean section.  Due to the length of time in the toxic womb, the baby suffered from cognitive impairment and Cerebral Palsy.

The mother was awarded a substantial settlement which allowed her to provide for her disabled daughter.

Surgical Error

$600,000 Confidential Settlement

Adam secured a $600,000 settlement for a young woman who was a victim of surgical error.

The woman underwent gallbladder removal surgery; the most common operation in America.  The surgeon negligently performed the procedure, allowing bile to spill within the woman’s abdominal cavity before closing her incision.  Only a few days later, the woman returned experiencing severe pain.  She was examined by another doctor who diagnosed her with peritonitis due to the bile spill.  The woman was required to undergo another invasive surgery that left her with a large scar across her stomach.

The substantial settlement awarded to Adam's client paid for all her medical expenses and also provided her with money for personal use.

Medical Device Error

$250,000 Confidential Settlement

Adam secured a $250,000 settlement for a young man whose medical device malfunctioned.

The man had a shoulder pain pump installed  for chronic shoulder pain.  The pump released too much medication causing the ligaments in the shoulder to erode.  As a result, the man required full shoulder replacement surgery.

The substantial settlement awarded to Adam's client paid for all his medical expenses and still provided him with money for personal use. Cases like these ensure that medical device manufacturers are held accountable and responsible for their misconduct.
